Private Mode allows two consenting adults to disable the automated NSFW content filter by mutual agreement. Both users must explicitly accept before Private Mode activates.
Even in Private Mode, Nightcap continues to monitor for illegal content, including but not limited to: child sexual abuse material (CSAM), credible threats of violence, terrorism-related content, and non-consensual intimate imagery. These categories are always monitored regardless of mode. Private Mode is not end-to-end encrypted. By entering Private Mode you acknowledge that Nightcap retains the right and obligation to scan for illegal content and to cooperate with law enforcement as required by law.
By entering Private Mode you acknowledge: (a) you are a consenting adult; (b) you choose to view unfiltered content at your own risk; (c) Nightcap is not liable for any content you encounter in Private Mode; (d) you may exit at any time using the "Next" button; (e) your ability to report a user is never removed. All other rules in this agreement still apply.
Generating, sharing, or requesting sexual content involving anyone under 18 — real or AI-generated — is a permanent, non-appealable ban. This applies in all modes including Private Mode. We cooperate fully with law enforcement and the NCMEC CyberTipline.
Do not harass, threaten, bully, or use slurs against anyone. This includes race, gender, sexuality, religion, national origin, or any other characteristic.
No automated scripts, bots, or tools. No unsolicited advertising or promotions. No requests for money, gifts, or personal financial information.
Recording another user's video or audio without their explicit consent is prohibited and may be illegal in your jurisdiction.
You may not use Nightcap for any activity that violates applicable local, state, national, or international law. This includes, but is not limited to, distribution of illegal substances, solicitation of illegal services, fraud, extortion, and blackmail.
To appeal a ban, email support@nightcap.chat. Bans related to CSAM or underage access are not appealable.

YOU USE NIGHTCAP ENTIRELY AT YOUR OWN RISK. NIGHTCAP DOES NOT ENDORSE, VERIFY, OR ASSUME RESPONSIBILITY FOR ANY USER-GENERATED CONTENT. BY ENABLING PRIVATE MODE YOU VOLUNTARILY CHOOSE TO RECEIVE UNFILTERED CONTENT AND ACCEPT ALL ASSOCIATED RISKS.
NIGHTCAP PROVIDES AUTOMATED MODERATION TOOLS AND HUMAN REVIEW BUT CANNOT GUARANTEE REAL-TIME MODERATION OF EVERY SESSION. IN NO EVENT SHALL NIGHTCAP'S TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO NIGHTCAP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Nightcap, its operators, affiliates, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the service, your violation of these terms, or your violation of any rights of any third party.

We provide automated moderation and human review but cannot guarantee real-time moderation of every session. Private Mode disables the NSFW content filter only — it does not create an encrypted or unmonitored channel.
Privacy: We do not store video or audio streams. Session metadata is retained for moderation and legal-compliance purposes only. See our Privacy Policy.
Governing Law: These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.
Severability: If any provision is held unenforceable, the remaining provisions continue in full force and effect.
Changes: We may update these terms at any time. Continued use after changes constitutes acceptance. Material changes will be announced via a banner on the site.
